What is E-Discovery?
Do you know what ediscovery is and what it is used for? Ediscovery, or e-discovery/electronic discovery is the process of retrieving or removing information stored in an electronic format. This information is used as evidence in a criminal case and can be used in a court of law. It is basically the process of securing or producing electronic documents like word processing files, emails, and other electronic records and similar.
Information can be taken from:
- Hard drives
- CD ROM read/write
- 3.5 floppy
- Docking station
- Zip/jaz drive
- Emails
- Online servers
- etc
Due to the fact that technology is such a common part of our lives together, it is no real surprise that it is now being commonly used as evidence in many cases. Ediscovery can be used in cases where a business or company is under investigation for something. The company’s files may be confiscated and examined for incriminating data.
Other cases when ediscovery has been used as evidence are in internet-related crime such as scams, child pornography or solicitation, etc. Files can be retrieved from the suspect’s computer and related hard drives and devices. What many people do not know is that even data that has been deleted can be recovered by an expert.
There are now computer forensic experts whose jobs are to find and retrieve this data on electronic media devices and to recover even lost and deleted files in a manner so that they are not destroyed and can be used as evidence in a legal case.
A company’s computers and files or an individual’s home PC can literally become a crime scene and is treated in that same way by ediscovery investigators and experts. There are attorneys that specialize in ediscovery and work with many businesses and companies to help them with their ediscovery needs.
